Paragraph 1 of Article 71 of the “Marriage and Family Code” (“Rights and obligations of parents to protect the rights and interests of the child”) states: “Parents are the legal representatives of the child and act to protect his/her rights and interests in relations with any individuals and legal entities.” According to this article, only parents or legal representatives with a notarized power of attorney may accompany a child to films with age restrictions if the child does not meet the age limit, and they are responsible for the child. This is confirmed by Article 72 of the Code (“Exercise of parental rights in the interests of the child”): “When exercising parental rights, a parent may not harm the physical and mental health of the child or his/her moral development.” Other persons may be legal representatives if the parents have delegated these rights under the Civil Code of the Republic of Kazakhstan through a notarized power of attorney. Cinema employees – specifically Cashiers and Administrators – have the right to verify that the accompanying person for a given film, according to its age restrictions, is a parent or legal representative. Liability for violating age restrictions is provided for in Article 159 of the Code of Administrative Offenses of the Republic of Kazakhstan.
